When a Brooklyn resident can no longer manage their own affairs — whether an aging parent in Bay Ridge, a young adult with disabilities in Flatbush, or a minor whose parents are unavailable — New York law provides a formal court process to appoint a guardian. The right court and the right statute depend entirely on the person’s age and condition.

Which Court Handles Your Case?

Situation Statute Court
Adult alleged to be incapacitated MHL Article 81 Supreme Court, Kings County
Minor (person or property) SCPA Article 17 Kings County Surrogate’s Court
Intellectually/developmentally disabled person SCPA Article 17-A Kings County Surrogate’s Court

How an Article 81 Appointment Works

Adult guardianship proceedings in Brooklyn begin with an Order to Show Cause and Verified Petition filed in Supreme Court, Kings County. The court appoints a Court Evaluator — and often independent counsel — to investigate the alleged incapacitated person’s (AIP’s) circumstances. The AIP has the right to attend and participate in the hearing.

To appoint a guardian, the court must find by clear and convincing evidence that the person cannot manage their property or personal needs and is likely to suffer harm as a result. Any powers granted must be the least restrictive intervention necessary — see our Article 81 Guardianship overview.

Before filing, explore alternatives to guardianship such as a Durable Power of Attorney (GOL §5-1513), Health Care Proxy, or Supported Decision-Making agreement — courts prefer them where sufficient.

Once appointed, a guardian must file an initial report within 90 days, visit the person at least four times per year, and submit annual reports to the court. Learn more about ongoing guardian duties.
